General Information

As you may know, a measure changing Texas' malpractice landscape was narrowly approved in a constitutional referendum on Sept. 12, 2003. Proposition 12, now law, keeps the courts from interfering in limits set by the Legislature on medical malpractice recoveries. In short, this is good news for you, and for all Texans. It means that insurance companies no longer need worry about astronomical judgments, which translates to lower premiums for your practice, lower costs to your patients.

For pain and suffering, (non-economic damage,) patients can still sue a doctor and, in unusual cases, up to two health care institutions. Now, though, they can seek no more than $250,000 from each for Pain & Suffering. Under limits adopted by the Legislature, plaintiffs can still recover economic losses, like the cost of continuing medical care or lost income, but the maximum award they can be granted in non-economic loss has been capped at $1.6 million, for a loss of life.

It took a little while for the market to realize the benefits of Proposition 12, but following its implementation in 2006, standard insurance market rates dropped all across the state of Texas. The medical liability reforms enacted in 2003 continues to have a beneficial effect on the marketplace today. We're glad to be able to pass on these savings to our customers.
